Introduction

Maine was first settled at the mouth of the Kennebec River in 1607 by a group of English colonists with the Virginia Company of Plymouth. This settlement, known as the Popham Colony, did not survive, and the proceeding decades were marked by competing interests between various European settlements. By 1636 the Province of Maine included several small communities: York, Saco, Cape Porpoise, Kittery, Scarborough, Falmouth, North Yarmouth, and Wells. In 1652 it became part of the Massachusetts Bay Colony.

The next century was fraught with a series of wars between the European settlers and the Native American people of the region. The wars, along with epidemics, resulted in many settlers leaving the region for the Bay Colony. These factors depleted the population, resulting in fewer than 1,000 settlers remaining by the start of the 1700s. Eventually the Massachusetts General Court created the Massachusetts Committee for the Sale of Eastern Lands with the goal of generating revenue through the sale of new settlements in the Maine wilderness. These efforts grew the population to over 20,000 by the latter part of the 18th century.

The boundaries of the region changed many times during the first 150 years due to competing European interests. The western boundary was defined by the border with New Hampshire in 1679. The eastern-most boundary was established by the 1783 Peace of Paris which used the St. Croix river as the dividing line between Nova Scotia and Maine, and the arbitrary description of the “height of land” established the border with Québec. The region remained part of Massachusetts until the Missouri Compromise in 1820, which forced a balance between free and slave states. The Compromise of 1820 separated Maine from Massachusetts, but Massachusetts retained ownership of half the available land within the borders until Maine was able to purchase it in 1853.

In 1860 the Maine legislation attempted to establish a centralized system of vital records but was met with little cooperation by counties and towns. Not until 1892, when legislation established a statewide vital records office and required all towns to report their earlier records, do vital records become readily available. Unfortunately, only 80 towns complied with the early record request and these vital records are known as the “delayed returns.”

Vital Records


Prior to 1892 – Records for birth, marriage, and death (including fetal death) are open to the public and may be purchased as certified or non-certified copies.

After 1892 – Birth, marriage, death, and divorce are available, and informational copies may be purchased by anyone within the following time frames:

  • Births >75 years from the occurrence
  • Marriages occurring >50 years from the occurrence
  • Fetal deaths >50 years from the occurrence
  • Deaths >25 years from the occurrence

Certified copies may be purchased by:

  • Persons named on the record
  • Spouse, registered domestic partner, parent/guardian, grandparent, sibling, step-parent, stepchild, aunt, uncle niece, nephew, mother/father-in-law, descendants.
  • The persons personal representative, designated attorney, or an agent or attorney for an agent designated by the person or by a court.
  • Officiant, informant, funeral establishment

Closed vital records are those records created outside of the open-record time frame. Access to these records is available to*:

  • Persons named on the record
  • Person’s spouse, domestic partner, descendant, parent or guardian, grandparent, sibling, step-parent, stepchild, aunt, uncle, niece, nephew, mother-in-law or father-in law.
  • Person’s personal representative or duly designated attorney, agent, or attorney for an agent designated by that person or by a court.
  • Genealogist holding an ODRSV Researcher Identification Card.

*Documentation must be presented to show proof of the qualifying relationship to the person in the record OR present an ODRVS issued by the Maine Center for Disease Control and Preventions Office of Data, Research and Vital Statistics.

Time Periods & Available Records:

  • Prior to 1700 – only Biddeford, Kittery, Kennebunkport, York, and Wells.
  • Between 1700 and 1820 - about 200 towns have vital records, but they may be incomplete and sparse.
  • 1820-1864 – After becoming a separate state in 1820, the practice of collecting vital records fell off. However, most towns collected marriage intentions and some births.
  • 1864-1892 – Civil records were required but not all towns compiled them. There are approximately 80 towns with records.
  • 1892-present – The Maine State Board of Vital Records was established, resulting in mandatory compliance of vital records collections.
